Marvel would occasionally produce a story that the CCA would have some problem with.

Sometimes, rather than change it, Marvel decided to just go ahead and publish it without the approval of the CCA, so the cover couldn't carry the CCA stamp.

Why was the comics code not there for both copies, doesn't make sense.

Both of these issues had something about the story or art that the CCA didn't approve of, so Marvel published them without CCA approval. They did that occasionally.

That's a mock-up cover scan. Not a picture of an actual book.

No actual copy of this book has the CCA stamp.

No, they were approved. It's just that Marvel Direct Editions from that time didn't carry the CCA stamp. Only Newsstand Edition did. But of course, if the book wasn't approved by the CCA, then neither edition carried the stamp.
