Fraudulant advertising, and a question...7365

So just over a week ago @KeyCollectorComics made a post promoting DIG auctions and telling everyone they are giving away a $200 auction credit "for any winning item in the auction which starts today." It also said: "Tap ENTER TO WIN and you will simultaneously be registered for the giveaway and link over to the D.I.G. auction."

I looked everywhere for the fine print on the DIG site, but that's all there was. So I tapped the link, registered, participated in the auction, and won one item.

Well, it turns out it wasn't a $200 giveaway for registering and participating, but a giveaway CONTEST, with only ONE $200 credit winner. No idea how the winner was chosen, but yeah, I fell for it.

I actually thought it was pretty brilliant. Even if you give every single auction winner a $200 credit, they will all pretty much factor that into their bidding. So DIG would basically get all that money back on the back-end. It's a wash, that gets them great publicity, more participation, and higher results for their inaugural comic auction.

Anyway, I had a talk yesterday with the guy over at DIG, and he was very apologetic. He assured me that all of their promotional materials were completely unambiguous, and included the fine print I was looking for; and was all clear that it was a contest, not a giveaway. All except for the one I showed him from @KeyCollectorComics, that they did not make or post or even know about. (They knew that KeyCollector was promoting their auction, of course .. they had partnered to do that. But DIG hadn't seen KeyCollector's ad, he said.)

He was very nice about it, and earnest about wanting to make up for the misunderstanding. But all he can do, he will either comp the shipping and insurance, or cancel the order if I'd rather.

So here's the question for everyone, and I'd really like y'all's opinion:

I won the auction for X-men 94 9.0, for about $650. Overstreet for this comic is about $950. I bought it to flip, thinking it would cost me only $450. If I sell it for $900 or so in the next few months, I get to keep about $800, so make about $150 on a $650 investment. It could sell faster, it could sell for more. The downside on the comic is: Cream to Off-White pages, which is terrible for a comic from 1975 IMO. So while I might keep it otherwise, this probably isn't the book for me.

I was also considering looking closely at it, as a possible crack press reslab. To go up a grade, to 9.2, would be pretty valuable, I think.

So, what would you do? Would you buy this comic for $650? Either to keep, or to sell? What are your thoughts?

If I wasn't sure, I wouldn't buy it.
I wouldn't really mull over it as you are doing.
Cream to off-white sounds normal to me for a 70's book.
Anytime you can buy a comic and make $100 profit in short time, I think that's good.

Overstreet is a not the standard to be comparing to anymore. You need to look at he most recent eBay or other auction site sales. What is there average/range for offwhite or lower? I bet it's no close to overstreet.

Also I would not cack it simply for a press. Too much risk there...and now you'r delaying reselling.

@Tedsaid - A 9.0 with C/OW pages sold two months ago on ebay for $735. Another 9.0 with OW/W pages sold for $709. Those sales are probably a good indicator of what you could get for that comic.

Overstreet is a joke.

I have the second highest copy of Archie Comics 84 for sale on ebay for $530. There are only two copies on the CGC census, the other copy is an 8.5. As far as I know my copy is the only one offered for sale.

I had a potential buyer offering $100 because Overstreet had the value of the book around $60.

Gocollect for X-Men 94 says for $650 you can either overpay a little for a 8.5 over underpay a decent amount for a 9.0 (http://comics.gocollect.com/guide/view/135359) . Sounds like you're on the underpay end, so you should be ok.

On the giveaway front, I read that and had no doubt it was a contest. When things say "enter to win", that means you probably aren't getting it.

Far too impatient for me....if you can buy a book, hold it a single year, then turn it for a profit why not....way I generally look at it, Con season just ended....press it, slab it and wait till a year from today after con season has driven sales higher again for it and see what the going rate is for it at that time. If you get it slabbed you can somewhat follow its progress through GPA.
Another aspect I feel should be added...its an x-men 94 and you seem worried about cream pages...that's a solid black cover on that book and every tiny crease and spine tick shows up annoyingly. I suggest that book with a tight clean cover is far harder to find than one with white pages ......if that turns out to be the case for the copy you won. Hard to say without scans but...

The big shows where the books that wind up listed as GPA sales are Chicago, SDCC etc....mostly summer months. Yes there are cons all year long but if you study the GPA you will find quickly the most sustained price increases occur during the summer months for the graded , slabbed reported sales. During the colder months movement for the heavyhitter keys may not cease but it does slow down considerably ....
Despite some peoples reactions to overstreet as a price guide, it is no coincidence it comes out directly prior to con season....rather than say, midwinter, or directly at years end.

I keep a journal of 32 books and follow their movements on the GPA for instance and I have to say I am very fond of their movements upwards as it seems to follow the mercury in the thermometer...

FYI, this year Amazon shipped my copy of Overstreet on July 30th. Last year it was July 7th. So not quite the end of con season, but I wouldn't call that 'before' either. (SDCC ran until the 23rd of July.)

That's a brilliant idea. Sort of like the Dow Jones of comics. What grades do you use? Are they keys, or non-keys, or a mix? Silver age, bronze age, etc?

I can see why you'd think that, looking back. But think about all the information that was (purposefully?) left out: unclear about the rules; didn't use the word "contest" or "chance" or "you might win" or anything like that; no explanation of when the winner would be chosen, or how, or how many; and no fine print at all. Hell, I don't even know if a winner WAS chosen ... no one ever mentioned it and it's gone from both websites.

Banks have giveaways, and everyone who does X gets the toaster, or whatever. Car dealerships do it, too. "The best giveaway we've ever had! Three years of service with every purchase!" Giveaways happen all the time, and unless they say it's a contest specifically, or limited to X number of winners, it's gonna come across as: Do THIS thing and you get THAT thing.

Hell, the law is, if you have a contest, you have to say what the odds are, or have a disclaimer if you aren't sure. They didn't post either of those things. (Because that would make it obvious that most people won't get the prize.) So that, too, makes it look like it's not a contest, right?

The fall is always the peak here on the East Coast.

The new Keystone show crammed in just before Baltimore and NYC has made a real gauntlet for anyone doing all three shows back to back.

The 32 comics I track are all keys I own or semi keys , late gold or silver age material. Grades are followed for one tier above and below each book that I have. That is my retirement and I do track it similar to the stock market or dow jones. I can tell you that the lot contains Showcase 22, green lantern 1, hulk1 ASM 1 , Avengers 1 TOS 39, TTA 27 , Daredevil 1, and JIM83..Hulk 102 Hawkman 4 , JIM 103 and 112, Tos 52, 63, 66, 79 Spectre 1, x-men 1,2,50 and 94 etc.
I keep another set of over a thousand books at home I similarly track with an eye to a new car, a house, and a "sale or ongoing income fund" as well
