You contact the seller first because:
1. It is the right thing to do (how would you feel if you were the seller?)
2. The seller can refund you faster than it takes to get a case resolved.
3. ebay has better things to do than resolve disputes that could easily be handled by talking directly and dealing fairly
4. If you keep crying wolf every time there is a problem without contacting the seller, eventually ebay is going to rule against you

You give people the chance to fix it. Not giving people the chance to fix a problem makes you what...? Right. A dick.
Any entity, person, company, whatever who has brought a lawsuit against another entity WITHOUT trying to resolve it directly with that other party first is (almost always) thrown out of court.
It's called "acting in good faith", and if you don't do it, you will (almost certainly) lose.
There will certainly be exceptions to that rule, but in general, you need to act in good faith, and part of that is trying to resolve the matter directly BEFORE involving other entities.
You make it sound as if following their own rules is somehow illegal.
Can you please explain how using the system eBay has in place is analogous to taking someone to court and not acting in good faith?
