That seller is one who should be avoided at all costs. What a lot of hassle!

2. The seller can refund you faster than it takes to get a case resolved.
3. ebay has better things to do than resolve disputes that could easily be handled by talking directly and dealing fairly
4. If you keep crying wolf every time there is a problem without contacting the seller, eventually ebay is going to rule against you

@Kav yes that it was he told me or that the post office did it. Funny thing is the envelope has no bends or tears. So I dont know how it got snapped in half.

Now that is interesting. Any severe temperature drops or reasoning as to how the plastic got so brittle it snapped like RMA?

This, but mainly #1.

You give people the chance to fix it. Not giving people the chance to fix a problem makes you what...? Right. A dick.

Any entity, person, company, whatever who has brought a lawsuit against another entity WITHOUT trying to resolve it directly with that other party first is (almost always) thrown out of court.

It's called "acting in good faith", and if you don't do it, you will (almost certainly) lose.

There will certainly be exceptions to that rule, but in general, you need to act in good faith, and part of that is trying to resolve the matter directly BEFORE involving other entities.

1. I hear what you're saying, but it's within their rules for me not to do this. I have done it before and it normally doesn't end well. So for sellers I haven't worked with before I go straight to eBay.

2. Only if the seller is actually willing to work with you. I have had the rare occasion where the seller offered me a full refund, including return shipping, but as I said, that is rare.

3. They have people whose job it is to handle disputes. I never really wondered or worried about if they had better things to do with their time.

4. Why do you call it "crying wolf"? That implies something completely different than a transaction going south and me using eBays system...which they created...to get a refund. I have used this system several times over the last 2-3 years and they haven't ruled against me a single time.

Also, why should I assume someone who packs a comic using a manilla envelope, with no other protection and is "suprised" that it got damaged..because they've done this "hundreds" of times and have never had a complaint before mine is going to be easy to deal with?
