If a buyer has expectations that post-purchase expenses would potentially need to be covered by the seller, they need to reach that understanding with the seller before purchasing. And probably a maximum amount should be agreed on. The seller should have the right to know those expectations in time to walk away from the sale and look for a buyer who doesn't have those same expectations. It's just not fair to the seller to come back later and say that expectations were that an unlimited amount of post-purchase expenses would be refunded, in addition to the purchase price.

I don’t. Who checks all their raws for restoration though?

Even higher end raws? Do we need to start putting this in the descriptions?

“Please see detailed photos. Book sold as is.”

Or “I can not guarantee this raw book has been restored”?

What about amateur restoration where they take a black marker and dot the spine ticks? How could you know? Do we all need to start putting disclaimers now?

If you're buying from a professional comic book dealer, then I would expect the book to be untrestored unless otherwise noted.

@multi007 when you ask "Who checks all their raws for restoration though?" I would hope anyone selling raws. Does this scenario change at all if you swap Restoration for Pieces/Centerfold Missing?

What is the minimum threshold of responsibility on the sellers part describing the condition of his raw book?

@HeinzDad when I sold raw books I checked every one for restoration...black light and all...inner and outer spines, etc because as a comic seller, I felt obligated to do that.

I guess it just depends where we place the bar of responsibility/accountability when we sell something.

Hypothetically, let's say person A buys a car from person B. For comparison sake, let's say A does not have the ability to do an inspection on the car so A take the car to a mechanic to do a tuneup go inspect it.

The mechanic does a tuneup on the car and says there is an issue with the engine.

Person A then goes back to person B and (based on scenarios in this thread) expects one of these options...

1) Seller refunds the purchase price AND the cost of the tuneup and inspection for the return of the car.

2) Seller refunds the purchase price and lets the buyer keep the car.

3) Seller refunds the purchase price and gets the car back, making the buyer eat the cost of the tuneup and inspection.

4) Seller gives a discount to reduce the original purchase price to match that of the actual FMV of the car if the mechanical information was disclosed up front. The buyer eats the additional after purchase expenses since those were going to be done by him after the fact one way or the other.

None of these seem perfectly fair to both parties. If we do a root cause analysis on this, the seller is the one who should logically be out of pocket since he is the one who sold something without complete disclosure. The buyer didn't get what he thought he was purchasing.

@GAC if you buy a book, you are buying all pages. That’s easy to discern.

Restoration that the buyer didn’t even notice himself should not be the seller’s fault. Especially since the buyer received a full refund.

Reasonableness here matters I think.

So everyone selling raws should add “as is”

Again, if you are making a living from selling raw comic books, you should have some sort of policy in place concerning undisclosed restoration and have it where potential buyers can see/read it.

I agree but with one critical caveat. What was in the description / communications to buyer? Any claim that the book was unrestored or any guarantee along those lines? If yes, then things change.

Silence on restoration implies no guarantee or assurance.

When buying raw I always ask before making an offer / bidding. I get a response in writing. It informs my bid as it reflects degree of risk and BURDEN of where risk falls.

Let’s add another scenario.

Let’s say the buyer did not get a refund from eBay.

2 months later, it comes back as restored.

What’s his recourse now?

I know I'm late to the party, but despite ebay issuing a refund for the item being late, the buyer should refund you the difference between the price you paid and the fmv of a restored copy of the book. They should refund you only because you paid additional money to have the book slabbed.

Jeez, guys. Where’s the love? I don’t have a particular opinion on who is at fault in this (hypothetical?) situation. Probably some blame on both sides. I will say that situations like this are the reason I very rarely buy or sell on EBay anymore.

@michaelekrupp I have no idea....I already settled this situation several hours ago with the other party with both of us walking away as lessons learned and no money being refunded or exchanged.

This thread was meant to be an exercise in how to professionally address these kind of situations before it went to pot.

@flanders If I offended you in any way before, I sincerely apologize. I don't know where or when I did but I obviously did, and for that, I am sorry. I don't want any beef with anyone on this forum. I like this forum. I like the people on this forum. Comics are supposed to be fun and I don't like drama in our place of fun.

Regarding this threads' topic. I already told the seller many hours ago that there is no expectations from me for any type of reimbursement but I felt the topic was interesting and had value.

Anyway, that is all.

I don't like drama and I certainly don't want to be the source of drama for anyone and if I was for you, please accept my sincere apologies.
