I have a feeling whoever bought that is going to question the validity of any other slabbed comics they own. Would they have a case against CGC to reevaluate any other slabs they own, since their credibility is even more questionable now?

I don't think the owner has any recourse here. I'm quite certain CGC has safeguards protecting them built in to there Terms & Conditions.

This is in their terms:

Due to the fragile nature of comic books, CGC does not offer a grading guarantee. However, CGC does offer the following guarantee: a) CGC guarantees that two or more comic professionals will review every comic book submitted for grading. b) CGC guarantees its holder to be free of defects.

I think you can make a good argument that in this case two comic professionals didn't inspect that book. If they were profressionals they wouldn't have made that error. Maybe a contract attorney on the forum can chime in for a more valid opinion, since I'm just a comic book guy in his 40s living with his mother.

I think anybody can sue anybody but in this particular case, I don't see the owner getting anything. CGC would fight this and win in my opinion.

We would need more information to make any intelligent conclusions.

Did this owner buy the CGC 9.6 blue label from someone else? If so, when?

If not and this owner is the original owner then there is definitely no recourse as the book is now correctly graded.

How many books get Universal labels and there's Restoration? Incorrectly graded? I think if lawsuits for this type of error were possible or third party graders were this susceptible, we'd be seeing lawsuits regularly...PGX still exists as a company...this is just my opinion of course.

I AM a professional accountant - I have an overseeing body who's tests I had to pass to get the designation of 'professional'. If I do a client wrong my 'professional' status can be taken away, I can face fines etc. - I HAVE to take 40 hrs or 'professional' development EVERY year that I want to keep my designation. I pay member dues - they don't pay my wage!

The "Trades" are professionals - with trade unions and certifications by third party bodies i.e. not the people paying them - if your gas fitter screws up your connection and blows up your house or just a mild case of carbon monoxide poisoning - they not only go to jail - they can no longer legally do the job

WHAT does a ""grader have??? - are they tested by an oversight body? do they need yearly training/seminars on say innovative methods of restoration?

are their graders even comic hobbyists?? or are they just trained low level employees?

TWO or more - prove it!! are they ISO or other certified??? are they audited regularly to ensure they follow their own practices of TWO or more reviewers?? post the ISO cert #!!

If someone had deep pockets or filed a class action I 100% think they could pull their terms apart

Individuals will always lose - they simply can't mount the attack needed - this person is SOL
If it became rampant....well... class action could do the job

The “outcome” part they guarantee is “The Collectible is authentic“ -
So of course direct recourse if a book is not the issue described (eg a reprint, forgery, etc). As it would not be authentic vs label.

Borderline cases that I’d argue is if extensive restoration is discovered. Arguably, despite views to contrary, a book with a bunch of pieces added “may” be viewed as not authentic if in a blue label case. Because a substantial part is not as described and was not original. Gray zone.

A missing coupon doesn’t meet the above so I think the buyer is SOL

The process part they guarantee (two pros). The pro part is a non-starter as they pay their employees and have some form of training. Mistakes happen and far worse mistakes happen than this so the outcome doesn’t call into question professionalism per se.

The two people inspecting, that part may be questioned as depending on process (and they should have one) it may be argued the likelihood of two people missing the error is low. Implies they skipped this. In reality I doubt they did. They may be able to defend if they keep formal track of this.

Since it was a small coupon in a high grade book I think this is just an error that we’d expect to happen. It seems they caught it the second time through, which actually shows how they are thorough in review even of very high grade books.

Right and all the pros and trades you mention make mistakes. Some they can be liable for, others not. No different.

In areas where (big) liability and errors go hand-in-hand (medical) the cost to insure drives pricing up massively.

Also, there is a distinct difference between contractual liability and tort. The grading companies open themselves up to massively higher insurance costs the more they include as guaranteed.

Gang this is one reason why I left comics behind (mostly) in favor of collecting original comic art.
And as we talk about holding CGC accountable: I'd guess as many people would root against a collector winning that case as others would be rooting for the collector.
Yes. Yes. I hear you. CGC made a big mistake and making it right would ease the minds of fee paying customers. But I contend that a big part of what motivates the desire to slab books has changed from detecting restoration or faults (missing coupon) and lends itself to foolishness. We're bombarding these "professionals" with so many books I'm convinced mistakes are coming from the volume handle. And we're also playing along with gimmicks like pressing. A lot of turning heads or burying them in the sand so long as our books come back ok.
My guess most collectors who read this will agree 9.8/9.6 over missed coupon is brutal. But very few are going to be hot about it in a meaningful way. We'll just keep sending in our books or buying them hoping it doesn't happen to us. I mean, let's say CGC did take a legal loss and it had a chilling and unforeseen affect on the market? Values plunge. Faith is lost. Legal challenges mount from collectors based on precedent. You start to worry about books you've bought or sold. Demands for free reevaluations on any book bought or sold through CGC swamp the company. They have to train and pay independently new inspectors. The company declares bankruptcy. Slabs mean nothing.
What if we have to crack them all one day to discover all the missed restoration, coupons etc? Maybe the time comes where all books are turned to Raw status and new technology comes to the rescue, something where a naked to the eye serial numbered watermark is added to your comics. Grading companies return and we start the entire process over from scratch? I'm nauseating myself.
I had a dream that as collectors we went so crazy that we slabbed every single comic book in existence. Only then did we realize what comics were originally meant to be read and enjoyed. Not slabbed and traded as commodities. Robert Heinlein type s**+ I know.
I protest too much. I think we've all gone into this knowing it's a bit sleight of hand.
